Pre-1915 Exposure-Occupational Diseases

Policy

In determining entitlement in occupational disease claims, the WSIB shall have regard for relevant pre-1915 exposure.

The onset of the occupational disease must occur after January 1, 1915 and must be in accordance with the Workers' Compensation Act or the Workplace Safety and Insurance Act that prevailed at the time of the onset.

Application date

This policy applies to all accidents. Benefits are payable from the date of accident, which is the date of diagnosis, or the first date that related symptoms are medically documented, whichever is earlier.
